This Privacy Policy explains how Simple Build, LLC, through its Simple Freight division (“Company,” “we,” “us,” or “our”), collects, uses, shares, and protects information in connection with the Simple Freight services (“Services”), our website, and related platforms.

This Policy is written to apply across jurisdictions. Where local law gives you specific rights or imposes specific obligations on us, those laws govern to the extent they apply to you, and the sections below describe how we meet them.

1. Who This Policy Covers

The Services are provided to freight brokers and third-party logistics providers (“Clients”). This Policy addresses:

  • Clients and Client users: the businesses that subscribe to the Services and the individuals who use them on a Client’s behalf.
  • Third parties whose data passes through the Services: for example, the senders and contents of customer request-for-quote (RFQ) emails and related shipment communications that a Client routes through the Services.
  • Website visitors: people who visit our website or contact us.

For data that passes through the Services on a Client’s behalf, the Client generally determines why and how that data is processed. In data protection terms, the Client is typically the “controller” (or “business”) and we act as a “processor” (or “service provider”), processing that data under the Client’s instructions and our agreement with the Client. For our own website, account administration, and billing, we act as the controller.

2. Information We Collect

Information you provide directly:

  • Account and contact details (name, business name, email address, phone number, job role).
  • Billing information, including payment card details, which are collected and stored by our payment processor rather than on our own systems.
  • Communications you send to us, including support requests.

Information processed through the Services on a Client’s behalf:

  • Inbound RFQ emails and their contents, including shipment details, origin and destination information, contact details of the sender, and any other information contained in those communications.
  • Quote data generated, gathered, or delivered through the Services.
  • Records, summaries, and transcripts of quote activity.

Information collected automatically:

  • Usage data such as log files, device and browser information, IP address, and interactions with the Services and website.
  • Cookies and similar technologies on our website, as described in Section 9.

We do not intentionally seek to collect special categories of data (such as health, biometric, or government identifiers) and ask that Clients not route such data through the Services unless necessary and lawful.

3. How We Use Information

We use information to:

  • Provide, operate, and maintain the Services, including reading RFQs, gathering missing shipment details, generating quotes, and delivering them into a Client’s transportation management system.
  • Set up Client accounts, process onboarding, and provide support.
  • Process payments and administer billing, including base fees and usage charges.
  • Monitor, secure, troubleshoot, and improve the Services, including detecting unreasonable or fraudulent use.
  • Communicate with Clients about the Services, including service and account notices.
  • Comply with legal obligations and enforce our agreements.

We use artificial intelligence and automated systems to deliver core functionality. Outputs may contain errors, and Clients are responsible for reviewing AI-generated quotes and communications where necessary.

4. Legal Bases for Processing

Where data protection laws such as the EU and UK GDPR apply, we rely on the following legal bases:

  • Contract: to provide the Services to Clients and administer accounts and billing.
  • Legitimate interests: to secure, maintain, and improve the Services, prevent misuse, and run our business, balanced against the rights of the individuals concerned.
  • Legal obligation: to comply with applicable laws.
  • Consent: where required, for example for certain cookies or marketing communications. Where we rely on consent, you may withdraw it at any time.

For data processed on a Client’s behalf, the Client is responsible for establishing a lawful basis for that processing and for any required notices or consents.

5. How We Share Information

We do not sell personal information.

We share information with:

  • Service providers and sub-processors who help us operate the Services, such as cloud infrastructure, payment processing, email delivery, and analytics providers. These parties are bound by contractual obligations to protect data and use it only to provide services to us.
  • Third-party platforms you connect, such as transportation management systems, CRMs, calendar systems, and SMS gateways, as directed by the Client.
  • Legal and safety recipients, where disclosure is required by law, legal process, or to protect rights, safety, or the integrity of the Services.
  • Business transfers, in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.

6. International Data Transfers

We are based in the United States, and we and our service providers may process information in countries other than the one in which you are located. Those countries may have data protection laws that differ from yours.

Where we transfer personal data out of the European Economic Area, the United Kingdom, or other regions with transfer restrictions, we use a lawful transfer mechanism, such as the European Commission’s Standard Contractual Clauses, the UK International Data Transfer Addendum, or another approved safeguard. 7. Data Retention

We retain personal information for as long as needed to provide the Services, administer accounts and billing, comply with legal obligations, resolve disputes, and enforce our agreements.

For data processed on a Client’s behalf, we retain it for the duration of the Client’s use of the Services and then delete or return it in line with our agreement with the Client, except where law requires longer retention.

8. Your Rights

Depending on where you live and the law that applies to you, you may have some or all of the following rights regarding your personal information:

  • Access to the personal information we hold about you.
  • Correction of inaccurate or incomplete information.
  • Deletion of your information.
  • Restriction of or objection to certain processing.
  • Portability of information you provided to us.
  • Withdrawal of consent, where processing is based on consent.
  • The right to lodge a complaint with a supervisory authority or regulator.

If your information is processed by us on behalf of a Client, please direct your request to that Client; we will support the Client in responding. For information we control, reach us through our Contact page (see Section 13). We will respond within the timeframes required by applicable law and may need to verify your identity before acting.

United States state privacy laws. Where state laws such as the California Consumer Privacy Act apply, you have rights to know, access, correct, and delete personal information, and to be free from discrimination for exercising those rights. We do not sell personal information or share it for cross-context behavioral advertising.

9. Cookies and Similar Technologies

Our website uses cookies and similar technologies to operate the site, remember preferences, and understand usage. Where required by law, we request consent before setting non-essential cookies, and you can manage your preferences through our cookie controls or your browser settings.

10. Security

Clients are responsible for safeguarding their account credentials and for the security of the third-party systems they connect.

The Services are intended for businesses and are not directed to children. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, please contact us so we can address it.

12. Changes to This Policy

We may update this Policy from time to time. When we do, we will post the updated version with a new effective date. Your continued use of the Services after an update takes effect constitutes acceptance of the revised Policy, except where applicable law requires more.
